Copyright Policy
1. Our approach
Speakle (speakle.ai), operated by I CAN LEARN LLC (Wyoming, USA), respects the intellectual property of others and expects everyone who uses Speakle to do the same. We respond to notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, and we apply the same process to notices from rights holders in any country.
When we receive a valid notice, we remove or disable access to the material expeditiously and we tell the person who posted it, so they can respond with a counter-notice if they believe the removal was a mistake.
2. What this policy covers
Most of what you see on Speakle is made by us. This policy covers the parts that people who use Speakle add themselves and that other people can see, including:
- Profile photos you upload, shown to your clubmates, your league, your duo partner and your peer-practice partners.
- Display names, which you choose and can change.
- Club posts: the lines from your own practice you choose to share with your club, and the note you add to them.
- Messages: comments and reviews after a peer-practice call, and messages and shout-outs a teacher sends to students.
- Teacher materials: an organisation's logo, and the assignments and other materials a teacher adds for their students.
If you want to report content that is abusive, unsafe or otherwise breaks our Terms of Service but is not a copyright matter, write to [email protected] instead.
3. How to send a takedown notice
If you believe material on Speakle infringes a copyright you own or are authorised to act for, send our designated agent a written notice that includes all of the following (17 U.S.C. §512(c)(3)):
- Your signature. A physical or electronic signature of the copyright owner or of a person authorised to act on their behalf. A typed full name is accepted as an electronic signature.
- The work. Identification of the copyrighted work you say is infringed, or, if several works are covered by one notice, a representative list of them.
- The material. Identification of the material you say is infringing and that you want removed, with enough information for us to find it, such as a screenshot, the page address, and the display name of the account that posted it.
- Your contact details. Your name, postal address, telephone number and email address.
- Good-faith statement. A statement that you have a good-faith belief that the use of the material in the way complained of is not authorised by the copyright owner, its agent or the law.
- Accuracy statement. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner's behalf.
A notice that is missing one of these elements may not be effective, and we may ask you to complete it before we act.
4. Where to send it
Send notices to our designated agent:
Designated agent: Copyright Agent, I CAN LEARN LLC
Email: [email protected] (please use the subject line "Copyright notice")
Postal address: 30 N Gould St, Ste R, Sheridan, WY 82801, United States
Email is the fastest route. This address is for copyright notices and counter-notices only; other messages sent to it about copyright may not receive a reply.
5. What happens next
- We review the notice and, if it is complete, remove or disable access to the material expeditiously.
- We notify the person who posted it that it was removed, and send them a copy of the notice (we may remove your telephone number from that copy).
- If the material is a profile photo, it is replaced with a plain initial or illustrated avatar. If it is a club post or message, it is removed from every place it appeared.
6. Counter-notice
If material you posted was removed and you believe that was a mistake or a misidentification, you can send our designated agent a counter-notice at the same address. It must include all of the following (17 U.S.C. §512(g)(3)):
- Your signature. Your physical or electronic signature.
- The material. Identification of the material that was removed or disabled, and where it appeared before it was removed.
- Good-faith statement. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your details and consent to jurisdiction. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the US federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which I CAN LEARN LLC may be found), and that you will accept service of process from the person who sent the original notice or their agent.
When we receive a valid counter-notice, we send a copy to the person who sent the original notice. Unless they tell us, within 10 business days, that they have filed a court action seeking an order to stop you from engaging in the infringing activity, we restore the material, or stop disabling access to it, not less than 10 and not more than 14 business days after we received your counter-notice.
7. Repeat infringers
We terminate, in appropriate circumstances, the accounts of people who repeatedly infringe copyright. An account that is the subject of repeated valid notices, where the material was not restored after a counter-notice, may be suspended or closed. We may also limit what an account can upload or share while a matter is being reviewed. For a teacher organisation, this can include removing the organisation's logo or materials.
8. Misrepresentation
Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. If you are not sure whether material infringes your copyright, for example because it may be a fair use, consider getting legal advice before sending a notice.
9. Changes and contact
We may update this policy; the date above shows the latest version. For general questions about Speakle write to [email protected], and for anything else about your data or your account write to [email protected].
